These terms and conditions ("Terms") govern your use of the www.eakers.co.uk website ("the Website") and any reservations or purchases made through it. Please read them carefully before using the Website. By using the Website or placing a reservation, you agree to these Terms.

The Website is operated by Eakers Ltd ("we", "us", "our"), a company registered in England and Wales under company number 16015551. Our registered office is at 128 High Street, Crediton, Devon, United Kingdom, EX17 3LQ. Our VAT number is  GB478149549.

2. About these Terms

The Website allows you to browse our product range and reserve items for collection and payment in our physical store. No payment is taken through the Website. All sales are completed in-store.

If you hold a credit account with us, separate credit account terms apply in addition to these Terms. Where there is any conflict, your signed credit account agreement takes precedence on matters it covers.

3. Using the Website

You may use the Website to:

•       Browse our products and prices

•       Check stock availability

•       Reserve items for in-store collection and payment

•       Access information about our store and café

You agree to not use the website for any unlawful purpose, nor to attempt to gain unauthorised access to any part of it, nor to interfere with its operation

4. Product information and pricing

We take reasonable care to ensure that product descriptions, images, prices, and stock levels on the Website are accurate. However:

•       Product images are for illustration only and the actual product may vary slightly (for example, in colour, finish, or packaging).

•       Prices shown include VAT where applicable but exclude any in-store services (e.g. cutting, mixing, delivery if offered separately).

•       Prices and availability may change without notice.

•       We reserve the right to correct any errors in pricing or product information. If you have reserved an item affected by a pricing error, we will contact you before the sale is completed in-store, and you will not be obliged to proceed.

5. Reservations

5.1 How reservations work

When you reserve an item through the Website, you are asking us to hold that item for you to view, purchase, and collect in-store. A reservation is not a contract of sale. No contract is formed until the item is paid for in-store. 

5.2 Reservation period

We will hold reserved items for 2 days. If you do not collect and pay for the item within this period, the reservation will lapse and the item will be returned to general stock.

5.3 Our right to cancel a reservation

We may cancel a reservation if:

•       The item is found to be out of stock, damaged, or otherwise unavailable

•       There has been an error in pricing or product information

•       We reasonably suspect the reservation has been made fraudulently or in bad faith

We will contact you as soon as reasonably possible if we cancel a reservation.

5.4 Changing or cancelling your reservation

You may cancel or amend a reservation at any time before collection by contacting us using the details in section 1. As no payment has been taken, no refund is required.

6. Completing a purchase in-store

When you come to collect a reserved item:

•       The sale is completed in-store at the point of payment.

•       Our standard in-store terms of sale apply at the point of purchase, including your statutory rights under the Consumer Rights Act 2015 (for consumer purchases).

•       Receipts and warranty information will be provided in-store.

Returns, refunds, and exchanges for items purchased in-store are governed by our in-store returns policy, available at the till and on request.

7. Credit accounts

Customers with an approved credit account may complete purchases on account in line with their signed credit account agreement. Reservations made through the Website by credit account holders are still subject to in-store completion and the terms of the credit account agreement.

8. Café

Information about café menus and allergens shown on the Website is provided for general guidance. Allergen information is also available in-store and we ask all customers with allergies or intolerances to speak to a member of café staff before ordering. We cannot guarantee that any item is free from traces of allergens due to the shared environment in which food is prepared.

9. Intellectual property

All content on the Website - including text, images, logos, and product photography — is owned by us or our licensors and is protected by copyright and other intellectual property laws. You may view and print pages for personal, non-commercial use only. You may not reproduce, distribute, or use any content for commercial purposes without our prior written permission.

10. Our liability

Nothing in these Terms limits or excludes our liability for:

•       Death or personal injury caused by our negligence

•       Fraud or fraudulent misrepresentation

•       Any other liability that cannot be limited or excluded by law

Subject to the above, the Website is provided on an "as is" basis. We do not guarantee that the Website will always be available, uninterrupted, or free from errors. We are not liable for any indirect or consequential loss arising from your use of the Website.

Where you purchase items in-store, your statutory rights as a consumer are not affected.

11. Privacy

Our use of any personal data you provide is governed by our www.eakers.co.uk/privacy , which forms part of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. The version in force at the time you make a reservation is the version that applies to that reservation. The current version will always be available on the Website with the "Last updated" date shown at the top.

13. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Complaints

If you have a complaint, please contact us using the details in section 1. We aim to acknowledge complaints within 2 working days and resolve them as quickly as possible.
